Aviation Law is comprised of complex domestic and multinational legislation which is subject to rapid change.
Aviation law services clients include manufacturers of aircraft and related objects, aircraft dealers and brokers, cargo and passenger airlines, lessors and lessees, aircraft management companies, financial institutions, insurers, airports, operators, suppliers and subcontractors in the aeronautics service industry, travel agencies, lenders, purchasers, and those who provide security services.
Areas of law often involved in the practice of aviation law include drafting and negotiating various types of agreements, competition law, international investment, corporate law, tax (including international tax), financing, insolvency, intellectual property and litigation.
Problems arise from the fact that different legal systems in different jurisdictions worldwide have different approaches to security, title retention agreements and lease agreements. This creates uncertainty for lending institutions concerning whether their rights are indeed effective. Consequently, this impairs the provision of financing for aviation assets, increasing borrowing costs.
We assist creditors and debtors regarding the Cape Town Convention and Aircraft Protocol, an international treaty dealing with security interests and their registration in an international registry. The primary objective of the Cape Town Convention and Aircraft Protocol is to deal with these problems and enable certain opposable rights to be obtained on high-value aviation assets such as airframes, aircraft engines and helicopters. These assets, by their very nature, generally have no fixed location.
